📝 Gutherema Real Estate – Terms of Service

Welcome to Gutherema Real Estate. By using our services, engaging with our website, or entering into a land purchase agreement with us, you agree to be bound by the following Terms of Service.

1. Definitions

  • “Company,” “we,” “us,” or “our” refers to Gutherema Real Estate.

  • “Client,” “you,” or “your” refers to the individual or entity purchasing land or using our services.

  • “Property” means any parcel of land sold, listed, or marketed by Gutherema Real Estate.

2. Services Offered

We provide the following services:

  • Sale of land across various counties in Kenya

  • Legal facilitation of land transfers

  • Site visits and virtual land tours

  • Flexible land payment plans

  • Land investment consultation (local & diaspora)

3. Eligibility

To use our services, you must:

  • Be 18 years of age or older

  • Have the legal capacity to enter into contracts

  • Provide accurate personal and payment information

We reserve the right to decline service for any reason deemed reasonable and lawful.

4. Land Purchases & Reservations

  • Land reservations require a non-refundable deposit, which may vary per project.

  • Full payment must be completed within the agreed timeline (unless under a formal payment plan).

  • A plot is not considered yours until full payment is received and title transfer is initiated.

5. Payment Terms

  • We accept payments via bank transfer, M-Pesa, or other official company channels.

  • For installment plans, clients must adhere to the agreed schedule to avoid delays in title processing.

  • Late payments may attract a penalty fee as outlined in the agreement.

  • All transactions are issued with official receipts.

6. Title Processing

  • Title deeds are processed only upon full payment and submission of all required documents (ID, KRA PIN, etc.).

  • Title deed timelines may vary by location but typically take 60–90 working days.

  • Gutherema Real Estate ensures all land is freehold or leasehold with clean title at the time of sale.

7. Refund & Cancellation Policy

  • Reservation fees are non-refundable.

  • In special cases, refunds (excluding reservation fees and administrative costs) may be considered for fully paid plots if cancellation is requested within 14 days of payment.

  • All refund requests must be made in writing to the company.

8. Site Visits & Due Diligence

  • Clients are encouraged to conduct physical or virtual site visits before purchase.

  • While we ensure thorough due diligence on all properties, we advise clients to perform independent legal verification if desired.

9. Intellectual Property

  • All content, images, videos, and material on our website or marketing platforms are property of Gutherema Real Estate and may not be used without permission.

10. Limitation of Liability

  • Gutherema Real Estate is not liable for delays or losses caused by:

    • Government delays in title registration

    • Acts of God (natural disasters)

    • Misuse of land by third parties

  • We will, however, always act in your best interest to resolve such issues.

11. Privacy Policy

12. Dispute Resolution

In the event of a dispute:

  • We commit to amicable resolution through negotiation first.

  • If unresolved, disputes shall be referred to arbitration under Kenyan law.

13. Changes to Terms
